Duplicating registered designs to become a criminal offence

On 1st October 2014, provisions of the Intellectual Property Act criminalising the duplication of registered designs will come into force. Under the Act, it will be a criminal offence to duplicate¬† a registered design in the course of business and without the owner’s permission, in order to create a product to the same design or to a design with no material differences. It will also be an offence to import, export or place such a product on the market, where the individual doing so is aware of or has reason to believe that a registered design right has been infringed.
